Auction terms

Auction terms & conditions

These terms apply to every sale conducted by KC Auto & Rentals LLC, in the lane and online. Registering as a bidder means you have read and accepted them. Last revised August 2026.

1. Bidder eligibility and registration

Bidding is limited to registered bidders age 18 or older who have completed registration, passed driver license verification, and posted the $500 refundable bidder deposit. Bidder numbers are personal and non-transferable.

KC Auto & Rentals LLC reserves the right to refuse registration or revoke a bidder number at any time, including for non-payment on a prior sale.

2. Bids are binding

Every bid placed in the lane, online, or by proxy is an irrevocable offer to purchase at that amount. When the auctioneer announces "sold," a binding purchase contract is formed between the winning bidder and KC Auto & Rentals LLC.

There is no cooling-off period, no financing contingency, and no inspection contingency after the hammer falls. Retracted or non-performed bids may result in forfeiture of the bidder deposit.

3. Buyer premium and fees

A buyer premium of 10% of the hammer price is added to every purchase, along with a $199 documentation fee and applicable Missouri sales tax, title, and registration charges.

Example: a $12,000 hammer price results in $12,000 + $1,200 premium + $199 documentation, plus tax and title fees calculated at closing.

4. Reserve and no-reserve lots

Lots marked "No reserve" are sold absolute to the highest bidder regardless of price. Lots marked with a reserve amount will not be sold below that amount; if bidding stops short of the reserve, the lot is passed and may be re-offered at a later sale.

Reserve amounts are published in the lot detail before the sale. KC Auto & Rentals LLC may bid on behalf of the seller up to, but not above, the published reserve.

5. As-is, where-is condition

All vehicles are sold AS-IS, WHERE-IS, with all faults and without any express or implied warranty of merchantability or fitness for a particular purpose, unless a written warranty is expressly attached to the lot at the time of sale.

Condition grades and condition reports are opinions offered as a convenience and are not warranties. Announcements made from the auction block supersede any printed or online description.

6. VIN and inspection window

Every lot publishes its VIN, mileage, and photos at least 72 hours before the sale. On-site inspection is available during the published preview period, generally the two days before each auction from 10 AM to 6 PM.

Bidders are responsible for their own inspection, history report review, and mechanical evaluation. Bidding without inspecting is at the bidder’s sole risk. Mileage is stated as shown on the odometer and may be listed as not-actual where the odometer reading cannot be verified.

7. Payment window

Payment in full is due within 24 hours of the hammer, by cash, certified check, wire transfer, or funded loan from an approved lender. The bidder deposit is applied to the balance.

Vehicles not paid for within 24 hours may be re-offered, and the defaulting bidder is responsible for any deficiency plus a $250 administrative charge. Storage fees of $35 per day begin 48 hours after the sale.

8. Title transfer and possession

Missouri title work is processed in-house. Titles are released once funds have cleared, typically within three business days. Vehicles may not leave the lot until payment clears and a bill of sale is signed.

Buyers are responsible for insurance from the moment of possession, and for registering the vehicle within the timeframe required by their state of residence.

9. Dispute resolution

Arbitration on undisclosed frame, flood, or title-brand issues may be requested in writing within three business days of the sale. Requests must include supporting documentation from a licensed inspector or repair facility.

Any dispute not resolved through the arbitration process shall be governed by Missouri law and heard in the courts of Jackson County, Missouri. Nothing in these terms limits rights that cannot be waived under applicable law.

10. Compliance

Auctions are conducted under KC Auto & Rentals LLC in accordance with Missouri auction regulations. Bidder registration and vehicle inspection are required prior to participation. Winning bids are binding contracts.
